Lousy Solutions offers advisory and treatment Services to families and small communities, e.g., schools and child care, to assist in the control, the prevention, and the understanding of head lice infestations.
 
1.2 Legal Agreement
The Lousy Solutions Terms of Use (“Terms”) set forth the entire terms and conditions applicable to each visitor to the Lousy Solutions Website and each user of the Services offered(“User” or “You”) by Lousy Solutions (“Us” “Our”), except where We explicitly state otherwise.
The Lousy Solutions Terms constitute a binding and enforceable legal contract between Us and You concerning the use of any of Our Services. You may visit Our Site and use Our Services only if You fully agree to the Terms set out here - and by booking, using and/or registering to any of Our Services, You signify and affirm your informed consent to these Terms. If You do not read, fully understand, and agree to the Lousy Solutions Terms, You must immediately leave the Lousy Solutions Website and avoid or discontinue all use of the Lousy Solutions Services.
By using Our Services, You also acknowledge that You have read and are in agreement with Our Privacy Policy which outlines, amongst other things, what data We might collect about You, why We collect it and how We use it. It can be found on Our Website (www.lousysolutions.com).

All Literature, promotional material, support material, program material and any content published and made available on Our Site, and through Our Services, is the property of Lousy Solutions. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of Our Website.
You may download and/or print off one copy of extracts of any page(s) from Our Website for your personal use and You may (in a non-commercial context) draw the attention of others to content posted on Our Website.
You must not use any part of the content on Our Website for commercial purposes without obtaining a licence to do so from Us (or Our licensors as appropriate).

Except where prohibited by law, by using this Site You indemnify and hold harmless Lousy Solutions and Our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of Our Site or Services, or your violation of these Terms and Conditions.

Although We make reasonable efforts to update the information on Our Website, We make no representations, warranties or guarantees, whether express or implied, that the content on Our Website is accurate, complete or up-to-date. We also do not warrant or represent that the information or materials available through the Website will meet your particular requirements or needs or that access to, or use of, the same will be uninterrupted or completely secure.
We reserve the right to make changes and improvements to any information contained within the Website, at any time and without notice.

3.8 Third-Party Endorsements
We do not endorse any specific products, processes, service providers, or other information that may be mentioned on Our Website (including, those promoted by any advertisers or advertising sponsors).

4. Services
 
4.1 Services Provided
These Terms and Conditions apply to all the Services that are displayed on Our Site and described in Our literature at the time You access them. All information, descriptions, or images that We provide about Our Services are as accurate as possible. However, We are not legally bound by such information, descriptions, or images as We cannot guarantee the accuracy of all Services We provide. You agree to purchase Services from Us at your own risk.

Our Services Include:

  • In-home head lice screening and treatment

We pride ourselves on providing a professional Service. While all care is taken, the clinical evidence is such that no single treatment is 100% effective 100% of the time. Treatment effectiveness cannot be guaranteed. Repeat treatments, performed by You or Us, 7-10 days later are always recommended.
 
Where a follow-up Service is requested, it must be booked at the time of the initial treatment to guarantee availability within the 7-10 day follow-up window.
 
Third-party proprietary anti-lice treatments can be requested in conjunction with the conditioning/combing (mechanical) treatment. We only use proprietary products that have been registered on the Australian Register of Therapeutic Goods (ARTG) We rely on the manufacturer’s label and instructions for use. We cannot guarantee the quality or accuracy of these 3rd party goods. Treatments are applied strictly according to the manufacturer’s instructions which You must make yourself familiar with before treatment, including the application and the quantity of the product required, the precautions, the contraindications, and the directions for follow-up treatments.
When an additional treatment is chosen You may purchase this yourself from a pharmacy before the appointment or through Us by prior arrangement and at Our stipulated price. We do not guarantee the availability of your chosen treatment.
Lousy Solutions has no allegiance to any anti-head lice product manufacturer.
 
In-home treatments are available within the Geographic Service Area (4.3.1) or by negotiation in surrounding suburbs. Surrounding suburbs may incur an extra travel fee.
 
Any information, advice or recommendations made by Us should not replace the advice of your healthcare provider. If the advice from your healthcare provider differs from Lousy Solutions’ recommendations, You should always follow your healthcare provider’s advice.
 

  • Head Lice Advice

Through Our Website, in-person and remotely by phone or video call, We provide information and guidance on head lice biology, control and prevention. We take steps to keep up to date with the latest information, but We make no representation as to the accuracy or completeness of the information We gather and disseminate.
 
The information and guidance are provided for general information purposes only. They do not constitute specific advice on which You or your community should rely. In particular, the information and guidance are not a substitute for professional medical care by a qualified doctor or other healthcare professional. If You are not a healthcare professional then You should ALWAYS check with a healthcare professional if You have any concerns about your condition or treatment and before taking, or not taking, any action based on the information or guidance that You receive from Us.
 
Where We reference information or clinical articles, or where We provide links from Our Website to information contained elsewhere, We make no representation as to the accuracy of that third-party information and We accept no responsibility in respect of any third-party websites or any information contained therein.
 

  • Head lice control tools and programs for schools, child care and other small communities.

We are committed to helping schools, child care and other small communities break the cycle of head lice re-infestation. Our tools and customized programs aim to prevent re-infestation and they require the participation of the community. However, We cannot guarantee the participation of the community and We make no representation that the tools or programs will eradicate head lice from the community.
Where information is to be distributed to the community, this must be done by the normal community channels. We will not take possession of mailing lists or be responsible for the distribution of communications.
 

  • Other tasks that the parties might agree on.

Where other tasks are requested of Us, You confirm that by requesting the task, You do so after having satisfied yourself that Lousy Solutions is capable and qualified to undertake the additional tasks.

4.2 Booking and Cancellation of Services
All Services can be booked directly with Lousy Solutions (phone, email, text) or requested via the Website. Bookings are not firm until confirmation is received by You via email or text message from Lousy Solutions.
We reserve the right to modify, reject or cancel your booking whenever it becomes necessary. If We cancel your booking and have already processed your payment, We reserve the right to reschedule it, or We will give You a refund equal to the amount You paid for any Service not received.
Cancellations made by You up to 24 hrs. before the time of the booking, will receive a full refund for services not received. If you have received advice via telephone or video call prior to the cancelled appointment applicable fees will apply (Fee Schedule (4.3.2).
Cancellation of in-home services within 24 hrs. of a booking will incur a cancellation fee equivalent to the Call-Out Fee as indicated in the Fee Schedule (4.3.2).
You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

4.3  Service Fees

  • In-home head lice screening and treatment

We will estimate the cost of the service based on information that You give Us at the time of the booking.The final actual charge may differ based on the factors outlined below. When You book the Service, You agree to pay the actual fee that is finalised once the service is complete.
An up-front payment equivalent to the standard single treatment, as indicated in the Fee Schedule (4.3.2), is due at the time of the booking. Alternative payment arrangements should be negotiated at the time of booking.The standard rate, as outlined in the Fee Schedule (4.3.2), is applied when:

  • the visit is within the boundaries of the Service Area, and

  • the treatment applied is mechanical i.e., uses a conditioning and combing technique; and

  • the single treatment can be completed within an hour of arrival.

Extra cost will apply in the following circumstances:

  • When the Services is provided outside the Service Area. (Extra costs will be applied based on travel time).

  • When the Service duration exceeds 1hr from the time of arrival. (Extra time may be needed depending on the length, thickness and coarseness of the hair, and the level of infestation and will be charged per 15-minute increments).

  • Where an additional proprietary treatment is applied. (Cost of proprietary treatments vary. You can ask Us for an estimate at the time of the booking)

  • When extra Services are requested on the day that were not included in the estimate.

  • When extra Products are required or requested on the day of the service that were not included in the estimate

Family discounts may be applied at Our discretion and, if applicable, will be accounted for in the initial estimate. Discounts are not automatically applied on follow-up visits or subsequent treatments.
Follow up treatments will incur the standard follow-up fee as outlined in the Fee Schedule plus any extra costs that might apply as outlined in this section.
If on arrival and inspection the treatment time required is estimated to significantly exceeds that anticipated from the information obtained at booking, one of the following will apply:

  1. Service proceeds to completion at an adjusted cost for the extra time. (dependent on Our availability)

  2. Service proceeds within the time originally allocated and with instructions on how to self-complete.

  3. Service is rescheduled. Call out fee is charged. The quote is adjusted to include extra time allocation.

  4. Service is cancelled. Call out fee is charged.

 

  • Remote Services – phone or video call

Phone or video calls are charged at a standard rate per 15-minute increment. An up-front fee equivalent to the fee for 15 minutes is charged at the time of booking.
 

  • Head Lice control programs – schools and child care

The tools and programs provided to schools, child care and other communities will be individually quoted after consultation to determine the services required and will include specified terms and conditions applicable. Quotes are valid for 30 days.
 
4.4 Service Fee Schedule
We reserve the right to adjust the Fee Schedule at any time and without notice. For up-to-date fee schedule always consult our website.

4.5 Payments Terms

4.5.1 Methods of payment

  • We accept the following payment methods:

  • Direct Bank Deposit (payID or online)

  • Visa and Master credit and debit card, Apple Pay, G Pay

  • Cash (in-home treatments only)

4.5.2 Payment Surcharge

  • All card-present EFT transactions (inserted or payWave) have a surcharge of 2.0%

  • Manually entered card payment or card payment made remotely, have a surcharge of 2.2%

​4.5.3 Payment due date
In-home Treatments

  • Upfront Deposit - An up-front deposit payment, equivalent to the standard single treatment, as indicated in the Fee Schedule (4.4), is due at the time of the booking unless other arrangements are negotiated.

  • Outstanding Fee - The remaining fee, over and above the deposit, is required as payment on delivery.

  • Alternative Terms - By negotiation only

    • Payment on delivery - Full payment required on the day of the service.

    • Net 7 days - Full payment required within 7 days from invoice date.

Remote advice

  • Payment required at time of booking​

School and Child Care​

  • Net 30 days (unless alternative stated on invoice) - Full payment required within 30 days of date of invoice​.

4.5.4 Late payment terms and fees
A late payment fee of $21 will be charged when payments are more than 14 days overdue to cover administration requirements for debt recovery. Interest will be charged fortnightly on payments due, at an annual rate of 10%. Overdue accounts may also be subject to recovery proceedings and may incur recovery costs.
 

4.6 Sydney Suburbs Serviced by Lousy Solutions Mobile Clinic

Our Mobile Clinic services suburbs in Sydney, the Lower North Shore, the Inner West, Ryde and some Eastern Suburbs.  See a complete list on our website. We reserve the right to remove or add suburbs at any time without notice. Surrounding Suburbs may be serviced by negotiation. The service of a suburb on one occasion does not imply ongoing servicing to that suburb. If services are agreed to outside of the listed suburbs a travel/toll loading fee may be added.

5. Consumer Protection Law

 

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

 

6. Applicable Law

 

These Terms and Conditions are governed by the laws of the State of New South Wales.

 

7. Severability

 

If at any time any of the provisions outlined in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

 

8. Changes

 

These Terms and Conditions may be amended from time to time to maintain compliance with the law and to reflect any changes to the way We operate Our Site and our Services. You should return here to review any changes to these Terms, each time, before using our Website or Services.
